Misleading Ads: Supreme Court warns states and UTs of violent action

The Supreme Court has warned states and Union Territories of defamation action for failing to take action against misleading advertisements. A bench headed by Justice AS Oka while reading the note filed by senior advocate Shadan Farasat, who is assisting the court as friend of the court, said, “We want to make it clear that if any state or union territory does not ensure compliance with the order. Then we will take action against the concerned state under the Rights of Courts Act, 1971. According to the affidavits, there was no trial under the 1954 Act yet. The issue of misleading advertisements came up before the court in 2022 while hearing a petition filed by the Indian Medical Association, which accused Patanjali Ayurveda Ltd of running a campaign against the Covid-19 vaccination campaign and modern medicine systems.
