The controversy in America is getting deeper due to a new decision of American President Donald Trump. The Trump administration has decided to impose a hefty fee of $100,000 on H-1B visa holders. Twenty of the 50 US states have now jointly appealed the decision in court. The states argue that the move is not only illegal but will also adversely affect important sectors like education and healthcare.

The suit was filed under California’s lead. The states allege that the Department of Homeland Security overstepped its jurisdiction when it imposed the fee in September. They argue that Congress never authorized the president or any agency to impose such high fees. Congress already has the authority to set rules, limits, and fees for H-1B visas.

States argue that imposing such high fees is intended to undermine the H-1B visa system. This would deter foreign talent from coming to the United States and exacerbate existing labor shortages. This will directly affect schools, colleges, universities and hospitals, as a large number of H-1B visa holders work in these sectors. According to statistics, about 30,000 teachers and 17,000 health care professionals are working in the United States on H-1B visas. The shortage of doctors is expected to reach 86,000 in the coming years. A hike in fees may further worsen the situation.

Currently, H-1B visa fees range from approximately $960 to $7,600. According to the states, raising this fee directly to $100,000 is impractical. The lawsuit also alleges that the Trump administration did not follow the proper rulemaking process and that the decision is against US law and the Constitution.
