The arrest was made on a serious charge. Gunathilaka met a 29-year-old woman through a dating app. On November 2, 2022, the two met at a bar in Sydney and later visited the woman’s home. They had consensual sex, but the woman later alleged that she was “stealthed”. Under Australian law, it criminalises sex without consent.
On November 17, 2022, he was granted bail under strict conditions. He was asked to surrender his passport, banned from using social media and dating apps, and was not allowed to leave Australia. Meanwhile, the Sri Lanka Cricket Board also suspended him. Gunathilaka was initially charged with four serious crimes, but in May 2023, the prosecution withdrew three charges due to lack of evidence. Only one case was heard. After a lengthy legal process, the court acquitted him of all charges in September 2023. After his acquittal, Danushka Gunathilaka returned to Sri Lanka and the ban against him was lifted, allowing him to return to cricket.
