Indian citizen Colonel Singh has filed a fresh petition in the Lahore High Court, demanding that his wife Sarabjit Kaur flee to Pakistan and annul her marriage to Nasir Hussain. Colonel Singh claims that Sarabjit Kaur left him and fled to Pakistan.
Sarabjit’s husband who fled India and got married in Pakistan has now filed a petition in the Lahore High Court. Sarabjit’s Indian husband, Colonel Singh, claims that Sarabjit converted to Islam and married Nasir without divorce in India, which is against the law. Colonel Singh’s lawyer Ali Chhegezi Sandhu argued that this is not correct according to the decisions of the Federal Shariat Court and the Constitutional Courts of Pakistan.
1. The petition states that these procedures were not followed in Sarabjit’s marriage, which made the second marriage illegal. The lawyer also alleges that having a second marriage is considered adultery and seeks criminal action against Nasir Hussain.
2. Colonel Singh has demanded that his wife be sent back to India and a rape case registered against Nasir. The petition also alleges forced conversions and sharing of private photos and videos, which needs to be investigated.
3. The court is also requested to keep Sarabjit Kaur in Mahila Asra till the case is resolved and her family should be allowed to interact with her.
According to lawyer Ali Chhezi Sandhu, before a married non-Muslim woman marries a Muslim man:
• Under the law of his country, he must obtain a judicial divorce.
• She should invite her non-Muslim husband to convert to Islam in front of two witnesses.
• If the husband does not convert to Islam, the marriage is considered void after waiting for 90 days.
Sarabjit Kaur came to Pakistan with a group of Sikh pilgrims on November 4 and stayed till November 13, but she did not return to India. Sarabjit married Nasir Hussain from Sheikhupura, Punjab, Pakistan. She also converted to Islam and has been living in Pakistan ever since. According to Ramesh Singh Arora, Minority Affairs Minister of Pakistan’s Punjab province, intelligence agencies swung into action on January 4 after learning about the presence of Sarabjit Kaur and Nasir Hussain in a village in Nankana Sahib. They submitted their nikahnama (marriage certificate) to the court, but Sarabjit’s Indian husband says she cannot remarry without a divorce.
