India Rejects Arbitration Court Order: The Hague Arbitration Court has scheduled a hearing on Pakistan’s objections to hydropower projects in Jammu and Kashmir, but India has categorically rejected the court’s authority. India says it never gave legal recognition to the court.

Pakistan News: A lesson learned when India abrogated the Indus Water Treaty, in response to Pakistan’s terrorist activities, Pakistan resorted to various countermeasures. In this context, Pakistan filed a complaint with the Court of Arbitration in The Hague, Netherlands regarding India’s hydropower projects. Pakistan had objected to India’s hydropower projects in Jammu and Kashmir, which was scheduled to be heard on February 2-3. Now, the court is seeking documents from India, which India has categorically refused.

The court judge directed India to share operational data related to the Baglihar and Kishanganga projects, a decision India clarified. India has clearly stated that it does not accept the Court’s jurisdiction. India considers its orders illegal and null and void. The government has said that it never recognized the court, and therefore, none of the orders apply to it.

Pakistan’s move failed

India argues that since the Indus Water Treaty itself is currently suspended, the existence of any arbitration body associated with it is automatically rendered ineffective. Therefore, the judgments of the court are not applicable to India. Earlier, in 2025, the Permanent Court of Arbitration (PCA) issued a supplementary order claiming jurisdiction to hear disputes related to the Kishanganga and Rattle hydropower projects. At the time, India’s Ministry of External Affairs reacted sharply, stating that India does not legally recognize the existence of such a court.

    India suspended the Indus Water Treaty in April 2025 after the horrific terror attack in Pahalgam, Jammu and Kashmir. In this attack, Pakistan-backed militants killed 26 innocent civilians, most of whom were tourists. Subsequently, India took a firm stand and made it clear that as long as cross-border terrorism continues, its obligations under the treaty will be revisited.

  • What is the Indus Water Treaty?

    The Indus Water Treaty was brokered by the World Bank between India and Pakistan in 1960. Under this treaty, India was given full control over the eastern rivers Ravi, Beas and Sutlej, while Pakistan received most of its water from the western rivers Indus, Jhelum and Chenab. India is allowed limited non-consumptive uses of these rivers, such as hydroelectric power generation. India’s stance is now clear that terrorism and dialogue cannot coexist. Until the situation improves, he will not accept any international order related to the Indus Water Treaty.
