As part of broader measures announced in September 2024, Immigration, Refugees and Citizenship Canada (IRCC) is making changes to open work permit eligibility for international students and family members of foreign workers. The information regarding this was released on Tuesday (January 14, 2025).

Canada’s move is said to benefit Indian students and workers working in natural and applied sciences, construction, healthcare, natural resources, education, sports and military sectors and all other labor-intensive sectors. Information released by IRCC suggests that under this change, spouses of eligible international students and foreign workers will be able to apply for OWP from 21 January 2025.

It is worth noting that spouses of international students will be granted a Family Open Work Permit based on specific criteria. This will be determined based on the duration of the study programs the student is enrolled in or what high-demand job fields the individual is working in. The notice also states, “Furthermore, foreign workers must have at least 16 months remaining on their work permit at the time the individual’s spouse applies for OWP.
In addition, the Canadian government will introduce stricter eligibility rules for dependent children of people working in Canada, who will no longer be eligible for family OWP.
